Smarddy Party Games ("Smarddy", "we") is a browser-based party-game service at smarddy.com and smarddypants.com. Smarddy is meant for family play; if you are under 13, play with a parent or guardian. By playing, you agree to these terms.

The service

Smarddy provides multiplayer and solo party games played in your browser. Rooms, scores, streaks, and leaderboards are ephemeral game data provided as-is, for fun. We may change, add, or retire games and features at any time. We may also update these terms; the date above tells you when, and playing after an update means you accept it.

Fair play

Don't cheat, scrape, harvest question content, disrupt other players' rooms, or attempt to access data that isn't yours. We may remove content, close rooms, or suspend or end access for terms violations, abuse, fraud, or safety risks. You may stop using Smarddy at any time.

Smarddy, our original game text, code, artwork, and the original selection and arrangement of our question banks belong to us. Facts, general game ideas, and third-party names do not. You may use the service for personal, noncommercial play, but you may not copy or redistribute protected content.

Names and content you enter

Player names and any answers you type may be visible to other players in your room, and names can appear on public leaderboards. By entering a name or typing an answer, you let us display it in the game as part of play. Keep them clean; we may remove names or entries at our discretion.

Purchases

If and when paid upgrades are offered, pricing and what's included will be shown before you buy, and payments will be processed by Stripe. Subscriptions renew automatically until you cancel. You can cancel any time through the self-serve billing portal, and you keep access through the period you already paid for. Except where the law says otherwise, payments are not refunded once a period has started. If a price increases, we will tell you before it applies to your next renewal. Purchases are for adults; if you are under 18, a parent or guardian must make the purchase. Passes and subscriptions unlock features for their stated period and are not transferable.

Third-party names

Third-party names and marks, including brands, bands, people, products, leagues, and teams, appear only for trivia, opinion, commentary, or reference. Smarddy is not affiliated with, endorsed by, or sponsored by any of them.

Disclaimer

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect or consequential damages arising from use of the service. Some dares in party games are physical. Every dare is optional; skip anything that isn't safe or comfortable for you, and adults should decide what's appropriate for kids playing along. Use common sense and play safely; you participate at your own risk.

Governing law

These terms are governed by New Jersey law. Any dispute must be brought in a state or federal court in New Jersey, unless applicable consumer law gives you another right.
